Terms of service

Contract and eligibility

Contracting party

These terms govern RAMSCloud, supplied by BLACK LONDON LTD, company number 16534792, registered office 23 Ashdene Road, Bicester, England, OX26 2BH. The customer orders the service; a user is authorised to use it. Anyone ordering for an organisation must have authority to bind it.

Business eligibility

RAMSCloud is supplied for business and professional use. Each personal account and subscription is for its named user; credentials must not be shared.

Contract formation and order of documents

The contract starts when you accept these terms and we activate the ordered service. Your order identifies the selected plan, price, billing interval and offer. The DPA prevails for customer-data processing; expressly agreed order particulars prevail for commercial details; these terms otherwise apply.

Service description

RAMSCloud helps prepare, edit, save and export RAMS, COSHH assessments and toolbox talks, with the libraries, evidence and communication functions available to your account. Features and allowances depend on your plan. AI provides drafting assistance. Future features are included only when released and made available.

Safety, accounts and content

Competence and safety boundary

RAMSCloud is a document-preparation tool. It does not supervise work, inspect sites, certify documents or approve that work is safe or legally compliant. You are responsible for checking the information you enter and for having a competent person review, adapt and approve all documents and AI-generated content before issue or use. You remain responsible for site-specific risk assessments, selecting and implementing suitable controls, and carrying out the work safely and lawfully. Generating, saving or exporting a document does not transfer those duties to RAMSCloud.

Customer responsibilities

Users are responsible for checking project facts, hazards, controls, risk ratings, COSHH information, emergency arrangements and the finished document before it is issued or used. A document name, exported PDF or final status is not a statement that work is safe, approved or legally compliant.

Accounts and security

Users must keep credentials secure, use the service only for information they are authorized to handle and notify the service if account security may have been compromised.

Acceptable use

Do not use the service unlawfully, infringe others’ rights, upload malicious content, bypass access or usage limits, attempt unauthorised access or disrupt the service. Do not upload passwords, API keys, payment-card details or unnecessary personal information. Processing of highly sensitive personal information requires prior agreement and appropriate safeguards. Use only relevant evidence and redact unnecessary identifiers. Do not represent generated content as statutory approval or evidence that a site action has occurred.

Customer content and confidentiality

You must have authority to submit and process customer content. We handle it for agreed service delivery, security, support and legal obligations through authorised personnel and providers. AI use follows the Privacy notice and DPA, including selected drafting inputs and support material processed for staff-reviewed replies.

Platform intellectual property

We and our licensors retain rights in the software, interface and original platform content. Access permits use for the agreed business purposes; it does not transfer platform ownership or third-party rights.

Customer content ownership

Customers retain their rights in the company, project and document content they submit. Submission does not transfer ownership of that content to RAMSCloud.

Licence needed to provide the service

Customers permit RAMSCloud to host, process, reproduce for technical operation, back up and return their content only as needed to provide, secure and support the service and meet applicable legal obligations.

Generated documents and outputs

You may use and share generated documents for your work with clients, contractors, workers, advisers and other appropriate project recipients. You retain rights in your submitted content; embedded platform material is licensed for use within those documents. Third-party licence conditions still apply. We do not promise that AI wording is unique, copyright-protected, non-infringing in every use or technically correct.

Third-party and licensed material

Third-party and public-sector material remains owned or licensed by its respective rights holder. Applicable source, attribution and licence notices continue to apply.

Rights complaints

Report suspected copyright or trade-mark infringement to support@ramscloud.co.uk, identifying the material, its location, the rights concerned and a reply address. We may request supporting details and restrict disputed material where appropriate.

Charges and service operation

Fees, invoicing and VAT

The price, currency, billing interval and allowances shown in your confirmed order apply. BLACK LONDON LTD, trading as RAMSCloud, is not VAT registered and does not charge UK VAT. Card-backed Stripe trials convert to paid billing unless cancelled as shown at checkout. Creating an account alone does not start a subscription. No-card trials and gifts do not create recurring billing by themselves. Failed payments may restrict paid access.

Renewal, cancellation and refunds

Stripe subscriptions renew automatically unless cancelled. Use Plan & billing to open the payment portal and check the cancellation and access-end dates shown there. No-card trials and gifts expire under their offer without automatically becoming paid subscriptions. Cancelling renewal leaves your subscription active until the end of the paid billing period. We do not normally refund unused time when you cancel for convenience. Contact support@ramscloud.co.uk about incorrect charges or service problems. Any charges or credits for a plan change will be shown before you confirm it. Nothing in this policy limits rights or remedies required by law.

Availability and support

Contact support@ramscloud.co.uk or use in-app Help & support where available. Maintenance, faults and external-provider issues can affect availability. No guaranteed response time or uptime SLA is included unless separately agreed in writing.

Changes to the service or terms

We may maintain and improve the service and make changes needed for law or security. We will notify affected customers before material adverse changes to paid features, prices or these terms take effect, with reasonable advance notice where practicable. Changes do not remove accrued rights or mandatory remedies.

Suspension and termination

We may restrict or end access where reasonably necessary for material breach, non-payment, unlawful use or security risk. We will act proportionately and give notice and an opportunity to remedy where appropriate. Contact support to challenge a restriction. Ending paid access does not itself delete saved data.

Data export and deletion

Account settings offers a document PDF export, workspace deletion and full account deletion, with the scope and checks shown in the app. The PDF export does not contain every personal-data category; contact the privacy contact for a complete rights request. Keep copies of issued documents and original evidence you need. Cancelling billing does not itself delete data, and deleting data does not cancel billing. The Privacy notice and DPA explain retention, return and deletion; product restrictions do not override statutory rights.

Risk and legal boilerplate

Warranties and disclaimers

We will provide the service with reasonable care and skill. You must assess its suitability and review outputs before use. We do not promise uninterrupted operation, error-free or accurate AI output, or automatic legal compliance. Nothing removes a responsibility or protection that cannot lawfully be excluded.

Liability

You are responsible for how you use the service and its outputs. We are not responsible for loss to the extent it is caused by inaccurate information you provide, misuse of the service, failure to review or adapt outputs, or unsafe site practices, rather than our own breach of contract or negligence. Nothing in these terms excludes or limits liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Individuals’ statutory data-protection rights and regulators’ powers remain unaffected.

General terms

A delay in exercising a right does not waive it. If a provision is unenforceable, the rest continues so far as lawful. These terms, the applicable order and DPA record the agreement, without excluding fraud. No third party may enforce them unless expressly stated.

Governing law and jurisdiction

The laws of England and Wales govern the contract and its courts have jurisdiction, subject to mandatory applicable rights.
